SMS Messaging Terms

01 Program Description

The Apex Narrative Group Messaging Program sends text (SMS) and, where supported, multimedia (MMS) messages to individuals who have expressly opted in.

Depending on which program you joined, messages may include:

  • Replies and follow-up regarding a marketing audit or strategy call you requested;
  • Appointment confirmations and reminders;
  • Notices about your active engagement with Apex;
  • Marketing and promotional messages about our services, insights and events.

This program is operated by [LEGAL ENTITY NAME], doing business as Apex Narrative Group.

02 How You Opt In

You are added to the program only when you provide prior express written consent. That happens when you affirmatively take one of these actions:

  • Check the separate, unchecked messaging consent box on a form at apexnarrativegroup.com and submit the form with your mobile number;
  • Text a keyword such as START to our number;
  • Give written or recorded verbal consent during a call or meeting, which we document.

We do not pre-check the consent box, and we do not add numbers on your behalf. Only provide a mobile number you own or are authorized to use.

Consent is not a condition of purchase. You do not have to agree to receive automated marketing texts in order to request an audit, schedule a call, or buy anything from us.

We keep a record of your consent, including the exact disclosure language you agreed to, the mobile number you authorized, and the date, time, IP address and page URL of your submission.

03 Message Frequency and Cost

Message frequency varies. Marketing messages are typically limited to no more than [4] per month. Messages tied to an active request or engagement are sent as needed and may be more frequent.

Message and data rates may apply. Apex does not charge for the messages themselves, but your mobile carrier may charge you for each message sent or received under your plan. Check with your carrier if you are unsure.

Messages are sent between 8:00 a.m. and 8:00 p.m. in your local time zone. We observe the stricter of federal and applicable state quiet-hours rules.

04 How to Stop Messages

Reply STOP

You can cancel at any time by replying STOP to any message from us. We also honor END, QUIT, CANCEL, UNSUBSCRIBE and REVOKE, and any other reasonable indication that you want the messages to stop.

After you send STOP, we will send one final message confirming you have been unsubscribed. You will receive no further messages from that program unless you opt in again.

We process opt-out requests immediately, and in all cases within ten (10) business days as required by FCC rules. Florida residents: under Fla. Stat. § 501.059, we have fifteen (15) days from receipt of your STOP request to cease text solicitations.

You may also opt out by emailing privacy@apexnarrativegroup.com, replying to any email from us, or telling any Apex representative. We will honor a request made through any reasonable method.

06 Carriers and Delivery

Supported carriers include AT&T, Verizon Wireless, T-Mobile, Sprint, Boost, U.S. Cellular, MetroPCS, Cricket, Virgin Mobile and others. Carrier support may change without notice.

Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier and is outside our control. We are not liable for delays, failures, or for any charges your carrier imposes.

If you change or deactivate your mobile number, you agree to notify us promptly so that we do not message a number reassigned to someone else.

07 Privacy and Your Mobile Data

No mobile information will be sold, rented or shared with third parties or affiliates for their own marketing or promotional purposes. Information sharing with subcontractors who support the messaging program — such as our messaging platform provider — is limited to what is necessary to deliver the messages, and those parties may not use it for any other purpose. Text messaging originator opt-in data and consent records are not shared with any third party.

08 Eligibility

You must be at least 18 years old and the owner or authorized user of the mobile number you provide. Do not enroll a number that is not yours.

This program is available to recipients with U.S. mobile numbers only.

09 Changes to These Terms

We may modify these SMS Terms at any time by posting a revised version here with an updated date. Material changes to the program will be communicated to active subscribers before they take effect.
